Stephanie Ogle and the Washington Department of Ecology, Jefferson County Washington and the City of Port Townsend are NOT doing ENOUGH to Protect YOUR Rights to Breathe Clean NON-Toxic Air.

The Washington Department of Ecology is NOT doing their JOB of protecting the Ecology of Port Townsend Washington. In fact the Washington Department of Ecology is allowing the Port Townsend Paper Mill to pollute our air and water and to continue to use 14 MILLION Gallons of Water a day in a time of EMERGENCY drought.

Stephanie Ogle of the Washington Department of Ecology is assigned to regulate the Port Townsend Paper Mill and claims to follow up on all odor complaints. However, all this seems to be is to contact the mill and see if everything was normal and okey dokey on that day. The Mill says Ya all is well and well that is that. So it would seem that the Washington Department of Ecology is really out to protect the mill and not the water, air, soil, and people in Washington.

Kind of like asking a criminal if they committed the crime, of course they say NOPE sure didn't.

Stephanie Ogle and the Washington  Department of Ecology is not really a People BEFORE Profit sort of group. Yet they are paid by public dollars. 


The Bottom Line is the mill is, in my understanding of the laws, breaking the clean air, clean water and clean soil laws. They are harassing us constantly and ruining our legal right to quiet enjoyment of property. The Port Townsend Paper Mill, I allege, is breaking the Clean Air Act, and yes are committing crimes on the residents of Port Townsend.

The Washington Department of Ecology allegedly logs odor complaints, SO WHAT. They are supposed to protect the water, soil, air and people of Washington. Instead they protect the profits of the Crown Paper Group, not even based out of Washington.

Complaining about Odor is Futile. They don't do anything but pay us lip service.

The DOE and EPA does NOT address the poisons we are clearly breathing nor the massive clean water that is poisoned by the mill. And for WHAT? The alleged smell of MONEY.

That money smell is for the lung doctors, the mill owners, the investors and not for Port Townsend. There are clean jobs that could come in and there is tons of clean up jobs. The PT Mill gets grants and lot's of hand outs, plus they use 14 Million Gallons of water a day. SURELY there can be a way to create 400 jobs in PT without poisoning us and ruining our quality of life.

Stephanie Ogle of the Washington  Department of Ecology gets her deep investigative results from the mill itself. 

And she says "Generally speaking, the operations at the mill were normal and the air pollution control equipment was operating within their normal ranges. They did not have any leaks/spills/abnormal releases during that period."

What does "generally" MEAN? This is our precious air. We have a right to clean air. The harassing smell that the PT mill puts out is toxic and annoying. There is no such thing as generally speaking. WE WANT FACTS, and the Clean Air and Water Laws OBEYED. The Washington Department of Ecology is SUPPOSED to make sure the laws are followed and not CODDLE corporations.



What does "normal" and "normal ranges" MEAN? 

Normal Ranges is the PROBLEM. The Mill's NORMAL toxic spewing is poisoning us, harassing us, and is in violation of the Clean Air Act. It is wrong, immoral and I believe flat out against the law to put these toxins in our air and water daily. The NORMAL RANGES need to be stopped as they are unconstitutional, unlawful and a complete violation of citizen rights and property rights.

Stephanie Ogle also says;

"While the emissions from the mill are within their normal operations, the weather can have an amplifying affect on the odors that are generated at the facility. It has been hotter and more humid recently and it looks like there are have been some periods of low to no winds, which can also increase the intensity of the odors. This may be why the odors have been worse during the past week.
I will continue to request that they investigate the odor complaints and I will let you know if they do find anything outside of their normal operating ranges."

ENOUGH with the blaming the Weather. JUST Stop the source of the toxins and DO YOUR JOB. Stop mumbling about weather, generally and normally and get STRICT about what is really going on. Protect the people paying your wage. The mill is SERIOUS bad every single day it is operating REGARDLESS of humidity, wind, weather or other mumbo jumbo.

STOP LETTING THE Bad Guys Regulate themselves. STOP calling the perpetrator and asking them if they are committing the alleged crime. INVESTIGATE yourself. Monitor the Air, Obey the Law.

Jefferson County Public Health of Port Townsend Washington is NOT protecting the Public Health nor the Civil and Human Rights of Jefferson County.

Jefferson County Public Health, Washington State Health Board, and the Port Townsend Police Department seem to have seriously failed the public in NOT disclosing the location or potential toxic hazards and health risks of Port Townsend, Jefferson County Meth Homes that they have been clearly aware of, to potential renters or occupants of a home.

Jefferson County Public Health is said to be one of the LEAST proactive local County Health Boards in the entire nation. Enough is Enough. The laws, ethics, standards, accountability and transparency NEED to Change.

The Port Townsend Police Department FUMBLED a HazMat Investigation.

Port Townsend CPS FAILED to report a Toxic home they knew existed. This endangered future tenants and now is harming children who live in the home.

The Washington State Health Board has FAILED the Public.

This is the story of one Port Townsend tenant that rented a Port Townsend home that was a Meth Lab. This was NOT disclosed to him though the Port Townsend Police and the Port Townsend CPS knew the home was a Meth Lab, as did the landlord Bent Meyer, a Washington Pastor and Counselor ( Bent Meyer, MA, LMHC ) and his son in law Steve Heemstra, I believe a local Pastor of Calvary Hill in Port Townsend.

Bent Meyers, Joanne Meyers, Steve Heemstra may face criminal charges as they will soon be named in a criminal complaint for their actions and lack of actions in public and child endangerment. Also accessory to a crime charges may be made against Jefferson County Public Health, Jill Buhler, John Austin, Phil Johnson, Veronica Shaw, Jared Keefer and Dr. Tom Locke.

Port Townsend Police Department has FAILED at not investigating this issue nor calling for a HazMat Investigation. Sergeant Ed Green now Chief of Police of Oak Harbor violated the civil and human rights of Port Townsend Citizens in this case.

I allege that all named above and more are personally and professionally LEGALLY liable to the current and former tenants of this home and with every other home in Jefferson County Washington facing this same Toxic Home and Public Health Emergency Issue.

Many Washington Counties have Meth Labs that were in homes. The Police know where they are, they should NOT be rented without FULL disclosure and notification of RISK, if not a FULL Clean Up of the home and property.

This is a MAJOR Civil and Human Rights Issue 
and a Public Health Emergency in my opinion.

"Port Townsend Paper Corporation created an Odor Survey Team during the summer of 1993. The purpose of the team was to determine the mill emission sources causing odors offensive to community residents."

Local newspapers published information on the
project and a hot line was set up to take odor reports and complaints.

The team met with the callers to fill out an informational survey and ask them to take an odor sample test.

Five emission odors captured in Tedlar bags were compared to the perceived odors
experienced by the caller.

The compiled information will allow the mill to concentrate future efforts on the emission sources that have the greatest impact in the community.


Port Townsend Paper Corporation is a kraft mill and like other kraft mills is characterized
by malodorous organic sulfide gases. Over the years, numerous complaints have been
directed toward the mill concerning the mill odor.

In 1992 the Washington Department of Ecology held a series of public meetings and concluded that most townspeople are concerned with the odors caused by local pulp and paper mills. It was evident that few people knew what was causing the aroma or its impact on the community.

A survey team was organized to:

1. Identify odors
2. Identify odor sources
3. Register complaints and concerns
The identified odor sources could then be examined more closely and possible remedies
could be determined.

The P.T.P.C. project was modeled after the ITT Rayonier P.A. survey concluded in 1992.
Emission Sources Eight major odor emission sources were found. These odors were observed and investigated by the Odor Survey Team It was found that four of the eight odors were similar to each other so all four were grouped into one category.

This distinct odor was synonymous with the M&D digester. The M&D digester Esco valve vents are the largest and most pungent of the four sources with similar odors.

The remaining four distinct mill odor sources are: the power boiler, the recovery furnace,
the lime kiln, and the aeration stabilization basin (ASB). The emission sources from
which samples were taken for the survey are described in the following paragraphs.
M&D Digester.

The M&D digester is a continuous digester used to produce pulp. The digester is
operated under pressure while a rotating Esco valve is used to feed the sawdust into the
digester. As the valve rotates, some vapors from inside the digester are forced out
through the valve and escape to the atmosphere.

Included in this odor category is the brown stock washer vent, smelt dissolving tank vent
and the digester fill vent. Each of these sources smell similar to a very dilute sample
from the M&D digester vents.


Power Boiler

The power boiler uses hog fuel (bark and wood scraps not used in the pulping process) as
its primary fuel source to produce heat and steam for the mill. It also bums oil and
primary treatment sludge as supplementary fuel.

The combustion products from the firing chamber are directed through a wet scrubber to
remove the particulate and ash from the air. The extremely hot air passing through this
wet scrubber produces a large visible steam plume coming from the stack.

Recovery Furnace

95% of the pulping chemicals used to make kraft paper are recyc1ed within the recovery
furnace. Most of the sulfur containing compounds which enter the furnace are fully
oxidized and recovered for reuse in the process.

A trace of S02 is produced by this combustion process but the concentration of 10 to 50 ppm is well below the limit of 200 ppm set by the Washington Department of Ecology.

The new electrostatic precipitator, completed in May, 1993, charges and removes fine particulate matter from the recovery furnace emissions at over 98% efficiency. Total Reduced Sulfur (TRS) gases exiting the furnace are generally below 10 ppm

Lime Kiln

The lime kiln serves two functions for the mill. Its main purpose is to convert calcium
carbonate precipitate (obtained from the white liquor c1arifier) into calcium oxide using
high temperatures (2200° to 2400°F).

The calcium oxide is then used to produce white liquor. The lime kiln also serves as an incinerator for odor gases that the mill collects from other processes. Odor gas compounds are broken down and oxidized to form compounds that can be scrubbed form the exhaust using a Venturi scrubber system.

Aeration Stabilization Basin (ASB)

The ASB is a series of treatment channels that clean the water used in the pulp and paper
making process. This secondary or biological treatment is nothing more than a
duplication of nature's own purification process, except that it is carried out under
contained and controlled conditions at accelerated rates.

Under aerobic conditions, micro-organisms (mostly bacteria and fungi) consume oxygen to convert wastes into the ultimate end products of carbon dioxide and water.

The anaerobic bacteria take over and continue biological action producing methane and hydrogen sulfide.

Pulp and paper mill wastes are essentially non-toxic following this biological treatment.

There are two components for the peculiar ASB odor. For one, sulfur gases produced
from biological action is highly noticeable in low concentrations. Secondly, foul vapors
condensed in the mill get dissolved in the mill effluent. This condensate is transported to
the ASB where the mechanical aeration devices free the dissolved odor gases into the
atmosphere."

"CITY HALL — The City Council approved a unique law this week that enshrined the rights of the environment and residents’ rights to clean air and water.

The ordinance, known as the Sustainability Bill of Rights, asserts that corporations and their leadership do not have special privileges or powers under the law that supersede the community’s rights.
It also requires that the Office of Sustainability and the Environment prepare a report every two years documenting progress on the Sustainable City Plan, an effort begun in the mid-1990s to create benchmarks and goals to make Santa Monica more environmentally friendly, and that City Hall hold a public hearing.
Finally, and perhaps most controversially, some believe that the law gives residents the ability to sue a polluter themselves when one of those rights are violated, without waiting for City Hall or other agencies to get the ball rolling.
The ordinance was, in Councilmember Kevin McKeown’s words, a fundamental power shift away from business interests and toward the community that has not yet happened in the environmental movement.
“Unrestrained capitalism has extracted the good out of our environment in many, many cases. Here, for the first time, we as 
a city are taking a stand and saying we’re not going to let that happen anymore,” McKeown said.

The Sustainability Bill of Rights emerged from the Task Force on the Environment — consisting of a group of residents — after the 2010 U.S. Supreme Court decision Citizens United vs. Federal Election Commission, which further cemented the rights of corporations as individuals in American law. The court’s decision opened the doors to unlimited campaign spending on behalf of companies.
The law was also a reaction to the spread of fracking, a process of extracting fossil fuels from the ground that many environmentalists say is extremely damaging to the environment, poisoning groundwater and even causing earthquakes.
The City Council approved a resolution in January 2012 backing the concept of the Sustainability Bill of Rights, but the resolution had no teeth. Those in support of the law passed Tuesday feel the City Council’s vote changed that.
“The fact that it establishes individual environmental rights is very important,” said Mark Gold, former president of nonprofit Heal the Bay and associate director of the UCLA Institute of the Environment and Sustainability.
Gold has spent much of his career fighting to save the environment from the negative impacts of human habitation on the Santa Monica Bay and other water ecosystems.
His primary tool was the Clean Water Act, a 1972 federal law that regulates quality standards for surface water, but the law lost effectiveness and involved arcane measurements that were difficult for members of the public to understand.
This ordinance finds strength in its return to basic environmental roots, Gold said.
Supporters of the Sustainability Bill of Rights believe that the law gives them the ability to sue polluters in court if City Hall does not do so. That could include what some call  Santa Monica’s “groundwater wars,” with over a decade spent in court to get companies to clean up dangerous chemicals that had leached into the groundwater through buried gasoline storage tanks.
“That legal standing did not exist before,” said Cris Gutierrez, a member of the Task Force on the Environment.
It was carefully-crafted to prevent abuse, and cannot be used to protect every street tree or stop every development in the city, Gold said.
“The ability of an individual to sue the city because they don’t like a development approval, that’s not in there,” Gold said.
Whether residents will be able to file any kind of lawsuit may be up to the courts to decide.
Jeff Caufield, an environmental attorney with the Los Angeles firm Caufield & James, thought there might be some conflict if a resident filed a private suit or acted as “a private attorney general.”
“It will likely need to be litigated and a decision made by a court on this particular ordinance and language,” Caufield said.
In the meantime, Gold hopes that the ordinance will keep the environment front and center for policy makers, and be a model for other cities who want to take a stand on the environment.
“There is a precedent-setting nature to this that the city is very aware of,” Gold said."
This is amazing, a HUGE precedence. Communities EVERYWHERE should take this example and stand up for your RIGHT to Clean Air, Clean Water, and Clean Soil.

Description

Nitrogen oxides (NOX) are a blend of multiple air pollutants that result from various combustion processes. The "x"; in NOX stands for one or more oxygen atoms connected to the nitrogen atom. NOXtypically occurs as nitrogen oxide (NO) and nitrogen dioxide (NO2), which are very commonly emitted in our everyday lives.

Sources include power plants, gasoline and diesel engines (cars, trucks, generators, lawnmowers and yard equipment, snowmobiles, power boats, etc), home furnaces (gas, oil, and wood), industrial processes, explosives, and fertilizers. NOX contributes to several air pollution problems.

One component of NOX that is considered a direct health risk is NO2, which is the actual NOX related pollutant with an assigned National Ambient Air Quality Standard (NAAQS). It can cause respiratory illness and lung damage. High levels can cause edema, and prolonged high exposure can produce fatal lung damage.

NOX is a primary component to ozone (or smog) formation. Ozone forms when NOX and certain volatile organic compounds chemically react in the presence of strong sunlight (ultraviolet wavelengths). An oxygen atom is moved from NO2 to oxygen in the air, creating ozone (O3) – another criteria pollutant. Reducing emissions of NOXis critical to reducing ozone.

NOX is also a major contributor to acid rain (or acid deposition). After NOX is released by a source, it travels and chemically reacts in the atmosphere, eventually becoming ammonium nitrate or nitric acid.

Ammonium nitrate is a small particle (PM2.5, which is considered to be another criteria pollutant with its own NAAQS), and it also is a visibility-impairing pollutant.

Nitric acid is removed from the air through precipitation (rain, snow, etc.), settling of particles, and by condensation from the air onto surfaces, similar to the formation of dew.

Acid deposition damages our forests, lakes, and wetlands by robbing them of necessary nutrients and lowering the pH levels, often to levels below what native species can tolerate.

The end result of this process is not a void of wildlife, but rather a shifting of species, where a more tolerant species simply populates an area where native species once were dominant. Nitric acid accounts for about one-third of the acidity in precipitation in New Hampshire.

Another effect of NOX is the nitrification of lakes, ponds, estuaries, and other wetlands. Nitrogen acts as a fertilizer for plants, and when it is added to water, algae and other aquatic plants may multiply excessively, displacing other inhabitants of the wetland.

While NOX emission controls have been added to power plants and automobiles (catalytic converters), growth in energy demand and the amount of vehicle-miles-traveled have offset some of the benefits of the control measures. In New Hampshire, measuredNO2 levels have remained relatively stable over the last 20 years, and have shown a slight overall decline. New Hampshire is in attainment of the NO2 NAAQS on a state-wide basis."

Jefferson County Courts: The Case of Travis Moegling and digging deep into the TRUTH about the Port Townsend Police and Who they Discriminate against Who They Beat.

Did the attack on Travis Moegling have anything to do with a Real Estate Vendetta or City Officials?  Was there anything to do with "Planning", Commissioners or those who wanted to discredit Travis Moegling?

"UPDATE: Travis Moegling who was arrested, tased and repeatedly punched by Port Townsend Police in June because he didn't have ID as a passenger in a car and who broke no laws had all the "Charges" dismissed by the Court this week as it was determined to be an unlawful seizure and unconstitutional arrest.

The Prosecutors office has indicated they will be appealing the Court decision to a higher Court. After speaking to an attorney in Seattle who handles appeals in Washington Supreme Court regularly and many cases that come out of Jefferson County Courts, he stated that this Prosecutor's office appeals more cases than any other jurisdiction in the State of Washington!

This is a troubling fact and is very clear that our local judicial system wastes huge amounts of tax dollar funds on their vindictive witch hunts. Even more troubling is the conduct of Judge Landes, who appeared to assist the Prosecutor in finding any reason for an Appeal and did so from the Bench and who also told the police involved in this violent incident that even though they acted inappropriately and beyond policy they "did a good job" Our local Court System is BROKEN and the people of Port Townsend and Jefferson County deserve better! Let's not take our Eyes off the NEXT election and replace Tyranny with better civil servants who respect due process and rule of law!"

Travis Moegling - Port Townsend Police Brutality

"This tasing incident has become a decimation of character. Whether the police were wrong or Travis was wrong is really for none of us to decide. What angers me the most is the character smearing that is going on. You cannot judge a man by one video and an article that was clearly written in favor of the police department. People should think before they speak such harsh words about a person and a ...situation they know very little about.

There is no law against going out for your 20 year reunion. The group was even responsible enough to have a designated drive. And you cannot judge a person by the way they respond to an attack while under the influence of alcohol and while being tased and beaten. Like Kim Meehan-Roulst said, you have that many volts running through you and see what comes out of your mouth…

If you read what the Leader and Peninsula Daily news are printing and you know Travis personally, I think you will agree that they are attacking this man’s character.

These are Travis's words regarding his recent tasing incident with the PT police department. “What's more disturbing to me is the character assassination going on. Stoked for those that are telling it straight! THANK YOU!!!!”

Here is what I know of Travis’s Character:

He has an awesome work ethic and a drive to excel. He has dreams and desires and he is willing to reach and stretch for them. He will not stand by while someone else is in need. He is kind-hearted, loving, brave and caring. He is extremely generous with his time and money. He is sure of himself and what he stands for. He is calm in spirit, content, happy, honest, patient and sensitive. He is trustworthy.

He stands firm on his beliefs and finds no shame in speaking about them. He unconditionally loves and encourages his children and gives them the support they need to excel. You may say this looks nothing like the man in the video or the man described in the papers. And that is my point!!!! His Character has been attacked and he has been made out to be a hardened criminal and trouble maker, which he is not.

If you know Travis Moegling, please post on one of the forums. Regardless of what you think of the tasing, give your testament as to his character. Travis needs some character witnesses on there and who better to give those than his friends and family that have known him for years.

Port Townsend News - Port Townsend Paper - PT AirWatchers -

"PORT TOWNSEND — Five environmental groups are proceeding with their appeal against Port Townsend Paper Corp.’s ongoing biomass project before the state Court of Appeals.

No Biomass Burn, the Olympic Environmental Council, the Olympic Forest Coalition, the World Temperate Rainforest Network and PT AirWatchers will file their first supporting brief by mid-July in an effort to get Port Townsend Paper to prepare an environmental impact statement on the project, Gretchen Brewer of PT AirWatchers said Tuesday.

The groups, which filed the notice of appeal May 9, are challenging an order entered April 11 by Thurston County Superior Court Judge Thomas McPhee that said further environmental review is unnecessary.

The $55 million project, expected to be completed next year, will expand the plant’s biomass facility to a 24-megawatt plant.

Brewer said in an earlier statement: “It is irresponsible to the community to allow the project to be built without a clear understanding of what it will do to our health, our forests, our roads, our waters.”

Brewer said the “ultra-fine” particulates that are produced by the burning of biomass — wood waste — for steam and electricity often lead to increased asthma, heart attacks and strokes.

“These are serious issues that need to be addressed,” she said.

Such particles are not specifically regulated by the Environmental Protection Agency.

Chuck Madison, vice president of human resources for Port Townsend Paper, said Tuesday “there has been no recent progress” in the biomass project."
